• X-Byte reserves the right to refuse service to anyone for any reason at any time.
• X-Byte will provide data that is not checked for its copyright owner/entity. You agree to respect copyright laws applicable to the content in question and use it responsibly. X-Byte will not be responsible for legal conflicts arising from your misuse of the provided data. You are the sole owner of your actions with the data.
• X-Byte may utilize some third party tools to execute your service requirements with your permission. Such third party tools will neither be monitored nor have any control over it. You acknowledge and agree that X-Byte is not responsible for any issues with the third-party tools that we integrate with our services/products. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

User privacy is important to us. Please read our Privacy Policy which can be found at Privacy Policy, carefully for details relating to the collection, use, and disclosure of your personal information.

By using the Services, you hereby agree and allow XByte.io to use the Name, Brand Name, and Logo for the marketing purpose to be published as a Clientele list.

All obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either party. User reserves the right to terminate the Terms of the Services at any time by notifying us that you no longer wish to use our services, or when you cease using our site. We may also terminate the agreement at any time without notice, if in our sole judgment you have failed, or we suspect that you have failed, to comply with any term or provision of these Terms of Service. User will remain liable for all amounts due up to and including the date of termination.

You are responsible for paying any applicable fees as set forth on the pricing and payment terms provided to and agreed upon by you at the time of your order, such as on an e-mail order or invoice, and applicable taxes associated with the Service in a timely manner with a valid payment method. You agree that we may charge you for selected payment method for any additional fees owed.

X-Byte shall have no right to resell User Data, except however, that you agree that X-Byte may use data derived from User Data, for purposes of operating, analyzing, improving, or marketing the Service and any related services. If X-Byte shares or publicly discloses information that is derived from User Data, such data will be aggregated to reasonably avoid identification of a specific individual or the User.

You need to represent, warrant, and agree that: (i) you have obtained the User Data lawfully and the User Data does not and will not violate any applicable laws or any person or entity’s rights; (ii) X-Byte takes no responsibility and assumes no liability for any User Data, and you will be solely responsible for your User Data and the consequences of sharing or disclosing it hereunder, including X-Byte’s use of such User Data as contemplated herein.

You are solely responsible for backing up your User Data on a regular basis, and taking appropriate steps to safeguard and ensure the integrity of your User Data.

You may choose to allow X-Byte to automatically retrieve data from your system(s) or third-party system(s)/services/sites on your behalf, you hereby represent and warrant that you have the permission, authority, and rights to use Service to access and/or to allow X-Byte to automatically access such system(s)/services/sites and retrieve User Data there from by indicating the same within your User Account. You agree that your use of the Service will not violate any terms of service, agreement, privacy policy, or any implied statements from any third party.

You own all right, title and interest (including all intellectual property rights) in and to your User Data.

X-Byte offers API as one of a delivery method to clients for programmatically accessing our services. The use of API is governed by the same terms and conditions mentioned on this page being a part of the services provided by X-Byte. You agree to make reasonable good faith efforts to ensure that others’ uses of any tools or software you create that use the X-Byte API do not result in any of the prohibited uses under these Terms of Use. You are allowed to use the API unless the service is terminated by from either party.

The Service is owned and operated by X-Byte. The products, services, software, API, visual interfaces, graphics, design, compilation, information, computer code, and all other elements of the Service provided by Xbyte.io. All trademarks, service marks, and trade names are proprietary to X-Byte.io or its affiliates.

Except as otherwise specified in these Terms, X-Byte makes no representation, warranty, or guaranty for reliability, timeliness, quality, suitability, truth, availability, accuracy or completeness of any Content or the services.

You agree to indemnify X-Byte and its subsidiaries, directors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or your violation of any law.

The failure of X-Byte to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by X-Byte.

Unenforceability or invalidity of one or more clauses in this Agreement shall not have an effect on any other clause in this Agreement. If it is possible, any unenforceable or invalid clause in this Agreement shall be modified to show the original intention of the parties.

This is the entire agreement between you and X-Byte relating to the subject matter herein and will not be modified except in writing, signed by both parties.

This Agreement and the documents referred to herein constitute the entire agreement and understanding of the parties with respect to the subject matter of this Agreement, and supersede all prior understandings and agreements, whether oral or written, between or among the parties hereto with respect to the specific subject matter hereof.

If you have any concern regarding the delivery then at first go report it immediately to project coordinator and assigned technical lead. If the reported issue has not been resolved then inform the same to your account manager from Business Development team. The concern account manager will surely do the needful to address to any of your concern.

If Account Manager also fails to address your concern then do write to us about your concern on sales@xbyte.io. Upon receiving the details of your concern, it is sole discretion of Management as to whether provide you full refund or partial refund.

While submitting your concern, we request users to claim the refund by mentioning the reason of discomfort. That will enable us to enhance our offering and overcome with the bottleneck or problem area if any.
